Followup on Houston's great K-Mart roundup from Metafilter. Having only read the the thread, it reminds me of what Lessig says about the lack of commons: so it's automatically bad that 278 people are peaceably assembled? Even if not, a K-Mart parking lot is private property, so they could have everyone removed for trespassing... but then, where can 278 teenagers peaceably assemble? We were guaranteed that, but that was back when there were publically owned town squares. When "town square" is a privately owned strip mall, where can you assemble?
